NOTICE OF 2019-20 BUDGET VOTE

PORTVILLE CENTRAL SCHOOL DISTRICT

The Board of Education of the Portville Central School District, Portville, New York, HEREBY GIVES NOTICE that a Public Hearing on the proposed 2019-2020 budget will be held at Portville Central School, Portville, New York on the 7th day of May, 2019, at 7:30 p.m. EDT in the John Dubots Room.

AND FURTHER NOTICE IS HEREBY GIVEN that petitions nominating candidates for the office of member of the Board of Education must be filed with the Clerk of the School District not later than April 22, 2019, at 3:30 p.m. The following vacancies are to be filled on the Board of Education: 5 year term of incumbents Douglas Doty and West Long. Each petition must be directed to the Clerk of the District, must be signed by at least 25 (twenty five) qualified voters of the District, must be filed with the District Clerk at least 30 (thirty) days prior to the budget vote on May 21, 2019, and must state the name and residence of the candidate. Blank forms are available in the superintendent’s office at Portville Central School.

AND FURTHER NOTICE IS HEREBY GIVEN that a copy of the statement of the amount of money which will be required for the 2019-20 fiscal year for school purposes, exclusive of public monies, may be obtained by any taxpayer in the district beginning May 7, 2019, at the school, during the hours of 7:30 a.m. - 3:30 p.m. on regular business days.

The following propositions will be presented for actions by the voters:

Proposition # 1 Shall the following proposition be adopted to wit: Resolved, that the Board of Education of the Portville Central School District, Cattaraugus County, New York, is hereby authorized to purchase two (2) school buses at a sum not to exceed Two Hundred Fifty-five Thousand Three Hundred Ninety-Three dollars ($255,393). And be it further resolved that the sum of not to exceed Two Hundred Fifty-five Thousand Three Hundred Ninety-Three dollars ($255,393.00), being the aforesaid maximum estimated cost or so much thereof as may be necessary, shall be raised by the levy of a Tax upon the taxable property of said School District and all other eligible legal fund sources; and in anticipation of such tax, fund sources and aid, obligation of said School District may be issued.

Proposition # 2 Shall the following resolution be adopted to wit: Resolved that the Board of Education of the Portville Central School District, Cattaraugus and Allegany Counties, New York, is hereby authorized to establish a capital reserve fund for the construction of improvements and additions to and reconstruction of School District buildings and facilities, including site and athletic facilities improvements, together with original furnishings, equipment, machinery, apparatus, appurtenances, and incidental improvements and expenses in connection therewith, at an ultimate amount of $2,000,000, plus accrued interest and investment earnings, with a probable term of ten (10) years, the source of funding to be surplus dollars and/or legally available funds available to the District when it closes its books every June 30.

Proposition #3 Shall the following resolution be adopted, to‑wit: Resolved that the Board of Education of the Portville Central School District, Cattaraugus and Allegany Counties, New York, is hereby authorized to construct improvements to and reconstruct various School District buildings and facilities, including site and athletic facility improvements, together with original furnishings, equipment, machinery, apparatus, appurtenances, and other incidental improvements and expenses in connection therewith, at a maximum estimated cost not to exceed $13,800,000, with $1,000,000 Capital Reserve Fund monies to be expended therefor, and the remaining $12,800,000, or so much thereof as may be necessary, shall be raised by the levy of a tax upon the taxable property of said School District and collected in annual installments as provided by Section 416 of the Education Law; and, in anticipation of such tax, obligations of said School District shall be issued.

SEQRA DETERMINATION. The School District has acted as lead agency under the State Environmental Quality Review Act regulations of the State of New York. The capital project herein authorized has been determined to be an “Unlisted Action" pursuant to the regulations of the New York State Department of Environmental Conservation promulgated pursuant to the State Environmental Quality Review Act (“SEQRA”), the implementation of which as proposed, it has been determined will not result in a significant environmental impact. SEQRA compliance materials are on file in the Office of the School District Clerk and are available for public inspection during regular business hours.

AND FURTHER NOTICE IS HEREBY GIVEN that applications for absentee ballots will be obtainable beginning April 22, 2019, between the hours of 8:00 a.m. and 3:00 p.m. Monday through Friday, except holidays, from the District Clerk. Completed applications must be received by the District Clerk at least seven (7) days before the election if the ballot is to be mailed to the voter, or the day before the election, if the ballot is to be delivered personally to the voter. Absentee ballots must be received by the District Clerk not later than 5:00 p.m., prevailing time, on Tuesday, May 21, 2019.

A list of persons to whom absentee ballots are issued will be available for inspection to qualified voters of the District in the Office of the District Clerk between the hours of 8:00 a.m. and 3:00 p.m. weekdays prior to the day set for the annual election. Any qualified voter present in the polling place may object to the voting of the ballot upon appropriate grounds for making his/her challenge and the reasons therefore known to the Inspector of Election before the close of the polls.

AND FURTHER NOTICE IS HEREBY GIVEN that qualified voters of the School District shall be entitled to vote at said annual vote and election held on May 21, 2019, between 1:00 p.m. and 8:00 p.m. EDT to approve the 2019-20 budget.

A qualified voter is one who is (1.) a citizen of the United States of America, (2.) eighteen (18) years of age or older, and (3.) a resident with the School District for a period of thirty (30) days preceding the annual vote and election.
